2024 REFERRAL INCENTIVE PROGRAM – TERMS AND CONDITIONS

Marvin Replacement, LLC (“Marvin”) will provide referral incentives to its homeowner customers, subject to these Terms and Conditions. 

Incentive Description & Eligibility:  Homeowners who have purchased installed windows and/or doors from Marvin are eligible to receive referral incentives under the program. Following installation of your Marvin products, you will receive an emailed referral code from Marvin. If a referral completes an in-home design appointment, receives a quote from Marvin, and provides your code or mentions your name at the time of booking the appointment, you will receive a $100 Amazon gift card following the referral’s completed appointment; subsequent appointments by the same referral are not eligible for incentives. If a referral mentions your name at the time of booking and subsequently completes a purchase from Marvin, you will receive a $400 Amazon gift card following the referral’s first completed purchase; subsequent purchases by the same referral are not eligible for incentives. Limit three referral incentives per year. Marvin, in its sole discretion, may substitute a similar incentive. Employees or agents of Marvin and its affiliates, subsidiaries, advertising/promotional/PR agencies, and the members of their immediate families or those persons living in the same household of such individuals are ineligible for incentives. 

Referral Period:  This incentive program may be modified or cancelled by Marvin at any time in its sole discretion without notice or liability. 

Taxes:  You are responsible for all taxes associated with any referral benefits received under the program. If your referral bonuses are $600 or more in any given year, you will be required to submit documentation, as requested by Marvin, sufficient to process a Form 1099 prior to your receipt of the incentive. 

Miscellaneous:  All issues and questions concerning the incentive program, including without limitation the construction, validity, interpretation and enforceability of these Terms and Conditions, shall be governed by, and construed in accordance with the laws of the State of Minnesota, USA, without giving effect to any choice of law or conflicts of law rules or provisions whether the State of Minnesota or any other jurisdiction that would cause the application of the laws of any jurisdiction other than the State of Minnesota. Any and all disputes, claims, and causes of action arising out of or in connection with this incentive shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall be subject to the exclusive jurisdiction of the federal or state courts within the State of Minnesota, USA. Marvin’s liability for any claim howsoever relating to this incentive shall be absolutely limited to an aggregate amount of $200; and by participating in this program, you waive all rights to claim, punitive, incidental, and consequential damages, and any other damages, and any and all rights to have damages multiplied or otherwise increased. Marvin reserves the right, in its sole discretion, to suspend or cancel any referral code supplied to a third-party website or aggregator or otherwise misused.
